Anyone know a housing lawyer that could help me answer some questions? My landlord changed the locks on my apt and refuses to give me a key but I'm still paying the rent.
Wendy O. replied:
It is illegal for a landlord to lock a tenant out regardless of whether the tenant is abiding by the lease or not. Landlord must follow due process: file a motion to evict in Housing Court for whatever reason it may be. If you are still the tenant of record you can go to the police and tell them you were illegally locked out. Also, lease reassignment is not that easy. Google Succession Rights in NYC or check out http://www.nyshcr.org/. Hope this helps, if you need more info, reach out to your local elected officials offices.
Dear Facebook,
Does anyone know of a lawyer(ish) person who could tell me what my options are if a landlord is trying to withhold my security deposit in NYC?
