  An individual called my office wanting to know if he could file a negligence claim against a club. The following happened: Individual was an innocent bystander at the club when someone started shooting in the club. Individual was injured in the incident. The injury required surgery and caused damage to individual's private area. Can he sue? Recommendations for those who handle these kind of cases?

  He can sue, but the general rule is a person is not responsible for the criminal acts of third parties. However, if the club knew or should have known that patrons routinely bring guns into the club and took no remedial measures, there is a good chanc e they can be held liable.
