Tl;dr Despite winning PEB on the second appeal with 50% retirement from the army (PTSD and back) and 90% VA, my husband just got notified that the army is chaptering him for failing a PT test instead of medically retiring him (despite service connections for both.) He failed the PT test because of his back, which is what kicked off the medical retirement stuff to begin with. PEBLO says neither she, her boss, or her boss’ boss have ever seen this situation go this way before. Planning to appeal to the BCMR. Anyone used an attorney for this and can recommend a really really REALLY good one? Three years of fighting on this so far and he’s not done yet. Thanks.
