  Jennifer, What your client needs is a bankruptcy attorney!! The scenario you described is typical of people trying to get modifications on their mortgages. Unless she is prepared to post a large cash bond to get an injunction the only thing that will stop a foreclosure, other than bringing the note current, is a bankruptcy.   I agree with Thomas that you have to have a credit counseling certificate to file bankruptcy but there is still plenty if time to do so before a January 4 foreclosure. The counseling course costs no more than $50 (and in some cases is free) and only t akes about 30-45 minutes online or over the phone. In my opinion a much better option for someone facing foreclosure than a TRO that is much more expensive and may not even work. Liza A.
