presumably their situation is they're being denied access to even register asylum claims on the presumption that they can't possibly have international protection needs because Morocco is considered a Safe Country of Origin? Knowing objectively what's legal and illegal is only a start in this situation. In practice, the lawyerly appearance of authority and skilfully building a rapport and working relationship with the police and officials is more effective than just shoving the law in their faces, because in the current situation they're obviously ignoring it and are likely to just kick you out, and then you can do nothing more to help. But to start with, here's the general context: Safe Country of Origin status legally can only be a presumption, and they have the right to challenge the presumption of safety in their individual cases in their asylum interview, and if rejected then, they have a right to a judicial appeal against the presumption of safety in their individual cases and public legal aid in making that appeal. Actually the Asylum Service Appeals Committee hasn't sat since December last year. Having a pending appeal normally has automatic suspensive effect on a deportation order, but I read something about this being changed in the recent Greek legislation a couple of weeks ago, so now appeals don't automatically have suspensive effect and the person can be deported, their appeal considered and then if upheld they'd have to be allowed to come back. To challenge the presumption of safety in their individual cases, they should look at the legal criteria for the presumption of safety to be applied: http://www.refworld.org/cgi-bin/texis/vtx/rwmain/opendocpdf.pdf?reldoc=y&docid=4bab55ea2 If they're claiming refugee status, then they should think about how the facts of their case compare with the legal definition of refugee status, and there's a UNHCR self-help guide here - http://www.refugeelegalaidinformation.org/sites/default/files/uploads/Self%20Help%20Kit%20English.pdf bit.ly/AsylPrepArab bit.ly/AsylPrepFrench If they don't have reasons for claiming Refugee Status, they may still have a right to subsidiary international protection if they can prove it's not safe for them individually to return to Morocco for other reasons than those which qualify for Refugee Status. General human rights context in Morocco: https://www.hrw.org/world-report/2015/country-chapters/morocco/western-sahara https://www.amnesty.org/en/countries/middle-east-and-north-africa/morocco/report-morocco/ http://www.ohchr.org/EN/Countries/MENARegion/Pages/MAIndex.aspx It's legal to positively presume Prima Facie ('on first appearances') Refugee Status in favour of applicants, e.g. Syrians, it's bloody obvious why they almost certainly all have Refugee Status now, it would be a waste of time to interview them all individually at this stage, on the other hand it is illegal to negatively presume any individual does not have Refugee Status based on their nationality or statelessness. If the police or officials are refusing to let them even register for a first interview, then that's straightforwardly illegal.
