You have to have a lawyer. They require a retainer fee. Check with those that do a free consultation first. You will also have to be bonded. I tried this a few years ago. Retainer fee was 2 k. If your brother is an adult, you can also contact Adult Protection Services. They help with social services and can give you assistance as needed as well. Good luck.

I'm not sure about a lawyer, but I do know that California is an "at will" state. So unless stated in a contract or such any employer is legally able to fire you with or without a reason. There are few limitations to the law. I found the link, maybe your situation is an exception. I've done some research bc I lived in Missouri and they are also an at will state. California does have more laws to protect their workers though, so maybe there is a loop hole. http://business.ca.gov/StartaBusiness/AdministeringEmployees/EqualEmploymentOpportunityLaws/AtWillEmployment.aspx
