You have to do both Federal and State nonprofit filing. We used BFI -- Business Filing Incorporated based in Madison, WI for the California filing. www.bizfilings.com phone number 800.981.7183. PLEASE NOTE: do not allow them to talk you into using them as your "registered fiscal agent." It's a yearly fee and all this "agent" does is receive miscellaneous notices and pass them on to you. The first year of this service was part of the filing package; thereafter it was $140 per year. Waste of money, for sure. Total cost for their filing service was $385. May be more now -- this was in 2005.

No one needs to hire a lawyer. We used The Foundation Group based in Nashville, TN. www.foundationgroup.org. Phone number 615.361.9445. They specialize in obtaining nonprofit status. They tell you which forms to fill out, how to do them and also provide a checklist of other things that are needed e.g., bylaws, mission statement, adoption contract etc. The IRS knows that documents prepared by this group will be accurate. We wanted to get our 501(c)(3) in as little time as possible; we got it in 90 days.

I was just talking with joe and you have to comply with state law in whatever state you are applying. If you don't comply in your state, you could lose your tax exempt status which would obviously affect your donors as well as yourself. This is an atty Joe knows - they have dogs and his wife volunteers at a not for profit for more exotic animals. His name is Andy Jackson and the number is 904-823-3333. Obviously ppl can go whatever route they want, but if anyone ever started investigating not for profits, I would want to make sure I complied.
