Does legal aid do divorce? Or do you know any reasonable divorce lawyers who do free consults? Pretty odd situation.... We have been separated for 4 years. He isn't a...
kliman replied:
Since it's a "no contest" divorce in Canada after a year of separation, you might be able to just use a "kit" from staples with a couple hours of a lawyers time.

If you meet the income guidelines, Calgary Legal Guidance will help. Google them or give them a call. Source: I'm a volunteer lawyer with CLG.

Legal Aid does accept family/divorce matters if you meet their income guidelines. You can call to apply at 1-866-845-3425.
calgaryyyclawyer replied:
Like Trish has said, it depends on your income guidelines. Having said that, you basically have to be unemployed to fall within those guidelines. Even if you don't qualify, you can do this without a lawyer. Your first step is to do some research. Since he is out of the country you'll likely have to also apply for a substitutional service order, allowing you to serve your documents via email or some other method. If you're ready to jump in, you can get all of the forms and the instructions on their website here: [https://albertacourts.ca/court-of-queens-bench/publications-forms/divorce-forms](https://albertacourts.ca/court-of-queens-bench/publications-forms/divorce-forms)
Zen_Rachel replied:
You'll be able to find it cheap but not free as there is still court filing costs. Divorce isn't like facing a jail term, so I would think legal aid wouldn't apply, but maybe. Here's a site that will mail you the papers and submit them for you for $250 [untietheknot] (http://www.untietheknot.ca/select-a-province/alberta/)
Because he is missing, you can file for divorce without his consent even with a child. The bigger thing though is to get full custody of your son, if you don't have it already with the domestic abuse charges. That will be a bit of money, maybe legal aid will help with custody papers. The risk of not having legal full custody papers is that he could come back and fly to his country with your son. Especially if it is a middle eastern country as the man makes the choices and in a country like Jordan, you will never see your kids again (even women need permission from their husbands to leave Jordan). Hopefully he's not from a country with different child custody laws. Even Japan just changed recently, joined UN on missing children, and will now return children that Japanese husband/wives took back to Japan.
Best of luck

Cori Lester, I believe the question was about legal fees and not real estate commissions! And yes, as with anything, realtors can and will negotiate where they can, such as when they are selling the home and representing the buyer. Why throw the realtors under the bus? They bring plenty of experience and negotiating skills to the table and it is the largest purchase of your life!!! While you're correct about the land titles tariff, meaning there are set fees and disbursements, meaning hard costs that are the same firm to firm, the law firm is clearly going to add their fee to that, it is still a business, which is where you will find the differences when you call around. A typical price on $300,000 purchase price is going to run you 1400 to 1700 depending on the firm. It is also different if you are purchasing vs refinancing, some companies do refinances through FCT, a company that will come to your home and sign with you vs law firm, in that case the flat fee is $485.00. Law firms are mandatory if you buy or sell real estate. Hope this helps!
