As long as there is a stipulation in the contract, tenant is resposible. Eviction, attorneys ..etc will cost too much money, you can: 1. Raise the rent to max allowed at the time of renewal. 2. Upon move out, deduct from the security deposit. 3. For the future, contact real estate attorney to create a good contract that protects your rights. It can make a huge difference in cases like this. We learned a hard way:(
