I suppose my issue is that both my association and an attorney for California Association of Realtors thought that this issue as described is legitimate.

Eric Farrar, CAR legal (and your association attorney) are wrong on this one. It's an oversight due to timing. He probably applied for the corp and and designated officer when he was still licensed personally. It's a clerical error. Call the BRE and tell them they have a unlicensed person and they will "correct" it.

I read the second section on the page, entitled LICENSING A CORPORATION AS A REAL ESTATE BROKER. THe third paragraph of that section reads, "When a corporation wishes to act as a real estate broker, the firm must be licensed by the Bureau of Real Estate (CalBRE) through qualified broker-officers, who have either passed the broker license examination and are now qualified to obtain a brokerlicense, or who are currently licensed as real estate brokers."
