So sorry, we have recently had a similar problem with a different contractor and know how frustrating it is. Even though our contractor had an "A+" BBB rating and some good references, we really made a huge mistake hiring him. Civil litigation might get you a judgement but if he has nothing, you will get nothing. It is worth checking Oklahoma Court Records On Demand, we discovered too late that our contractor had several previous judgements against him and his company. The link is: http://www1.odcr.com/
