This is a so-called Regulation E issue. Most overdraft fees are now regulated, and you must "opt in" before the bank is allowed to charge such. Make it clear that the crazy overdraft fees are not something you ever agreed to. There are a few exceptions, but BOA should be willing to refund most, if not all, of the overdraft/NSF charges.
