PS SPS may be a sub-servicer in some cases when a loan goes into default. However, in the Contimortgage trust pools for example, they either bought or were assigned as Servicer from the Bankruptcy court and/or MBIA Insurance Co....the Ins. Co. for the pool.

SPS does not originate loans. They do not lend money. They service the loans as a third party debt collector. In your case, they may be a sub servicer. Have you tried to look up your pass through certificate series on the SEC.GOV site? Give me the link in Florida where they say they are originators...if correct, shows more of their lies! Grrrrrrrr!

More like waste Tax Payers Money to commit fraud on the court and commit felonies i.e. phony declarations and briefs. They have every trick in the bag with help of Fidelity National Title and its ccompanies LSI and LPS and then other title companies who join in.. the more the merrier.

However, Bill Gammon has a good reputation and is the FIRST atty we have seen that really cares and gives a toot to help people. God, please make more like him!

Hi Dorsi, Donna again. I just sent you a message with Gardner's link. If Bill Gammon doesn't know of anyone there, try asking Brad Keiser on this site. Did you try the Atty's that get it list on Garfield's site? Fight and do not move out of that house! I forget...is California a judical or non-judicial foreclosure state? Judicial means they have to take you to court to get you out. Non means they can stamp paper work and your out! Go to the county land records online and the court house to see if they post anything for sale. Sometimes, they lie to you and foreclose anyway so, stay on top of it. If all else fails, GO to Legal Aid. You can sometimes get a forensic loan audit done too to slow it. Look up Gore Law firm in Houston and they can link you to their auditor. I wish I knew a better one, maybe Brad Keiser can do one for a fee as he is a banker that worked with Neil Garfield...ask him. He is very busy so, I don't know! God be with you!

Kevin, look up NYC attorney Carl Person. He may be licensed to work in NJ which is a stones throw from NYC. Carl has many youtube videos. Go watch him. He may work pro hac vice aka under another atty's license.

Hi Jasmin, I just posted an attorney link under Maria Voulo below. Look up the list of Attorney's Who Get It from Neil Garfield's site. Max Gardner (N.C) has an Atty reference on his site (Bankruptcy Bootcamp). Don't let the bankruptcy word confuse you. The atty's there are trained by Max (Politician and Atty) in fighting these bums back! You are in one of the worst states for this fraud along with Florida! Now, you have much work to do! First, stop talking to them by phone. We really need to list this in a blog. Send them certified mail to cease all telephone communications. After they sign it buy a recording device at Radio Shack and if they call, ask them their name and Company. SPS never obeys these demands! They are harassing us now in spite of a cease communications letter. Now, take them to small claims and sue under violations of Fair Debt Collection Practices Act- Section on Do Not Call. I think it is $1000 award to you per call. They have to get you on the phone from what I read. Keep a log. Sorry I got side tracked. Have you looked in your county land records (County Clerk @ Courthouse) online or at the courthouse to see if they have an assignment of mortgage aka Assignment of deed of trust (depends on State)? Look that up to see when the last assignment was if at all. Do you know if your loan was securitized? Is there a trustee named? Hold on and fight back! Many people make the mistake of not seeking legal advice and pay these crooks only to find they take the cash and the house! So, saying all that...GET LEGAL ADVICE! Do not stay with any atty that does not believe in mortgage fraud or wants to modify the loan with the servicer if said servicer does not own the loan! Only the owner/holder can modify the terms of the loan note contract between you and them...not a debt collector like SPS! I feel for you...you have the worst BOA and SPS! God be with you all and fight back!
