At the very least, I'd recommend heading over the the [county clerk's](http://www.co.travis.tx.us/county_clerk/dba.asp) office Monday and setting up a DBA for $13 until you get the LLC (or whatever it is you decide to do). After that, a gold bracelet and a name badge and I think you'll be all official. Also, I had a good conversation with a couple mentors at [Austin's SCORE](http://scoreaustin.org/free-small-business-counseling/) office when I started a small business. They can probably help you in guiding you down the right path to protect your brand/company, and would probably have good recommendations for lawyers to serve your need should you need to hire one.

I'm not a lawyer but I do know quite a lot about copyright and trademark law having spent the last decade as an entrepreneur.
Firstly, copyright is automatic, anything you create (that can be copyrighted) is automatically copyrighted, and you own the copyright. You aren't even required to do that "(c) Copyright 2011 chroniCThoughs" thing, and you don't have to register it with any government organization.

Probably your best strategy would be to find a lawyer and have them send the person a nastygram, essentially a legal threat. Hopefully that will be sufficient to stop them, because actually taking it to court could get very expensive very quickly.
You'll want to get a lawyer with experience of intellectual property law, I don't know any personally but WSGR is a good firm, you can find a list of their Austin lawyers [here](http://www.wsgr.com/WSGR/DBIndex.aspx?SectionName=attorneys/_hsb_OPResult.htm).
Be sure that you get an idea of how much this will cost up-front to avoid any nasty surprises down the line.
