What would be your recommendation to the SUNSET Commission about the State Bar of Texas? This has come up in various threads and I received (another ) call yesterday...
Andrew T. replied:
Steve would NOT be President during Sunset. Neither would Trey. The Presidential term of the winner of this 2013 race ends before Sunset activities begin. Here are the dates as proof: June, 2015: (When Presidential Term Ends) The winner of this current President-Elect race will serve as President from at or about June 19, 2014 to June 19, 2015, depending on the annual meeting date in 2015. October, 2015: (When Sunset Begins) First Sunset activity is when "Agencies submit Self-Evaluation Reports" in October 2015. (http://www.sunset.state.tx.us/reviewsch2012.pdf). Even if the Annual meeting is June 30, 2015, that's two whole months, plus October makes 3, to BEGIN to get the reports done long. Those reports happen long after Steve or Trey are gone. Regardless, does anyone seriously think Steve or Trey would do an Agency Self-Evaluation Report singlehandedly with the future of the Bar hanging in the balance? GMAB. All this fear being sold about testifying in Sunset hearings-- that would happen AFTER Steve or Trey would be gone too. Above dates prove it. This comment is open to editing if anyone has dates with greater precision for inclusion. Thank you.

There are self-evaluation reports for various state agencies floating around online. Some look very detailed and time-consuming. Here is the most recent one for the Railroad Commission: http://www.sunset.state.tx.us/82 ndreports/rct/ser.pdf
Andrew T. replied:
Joanne, "in 1977, the Texas Legislature created the Sunset Advisory Commission to identify and eliminate waste, duplication, and inefficiency in government agencies. The 12-member Commission is a legislative body that reviews the policies and programs of more than 150 government agencies every 12 years. The Commission questions the need for each agency, looks for potential duplication of other public services or programs, and considers new and innovative changes to improve each agency's operations and activities. The Commission seeks public input through hearings on every agency under Sunset review and recommends actions on each agency to the full Legislature. In most cases, agencies under Sunset review are automatically abolished unless legislation is enacted to continue them." Source: http://www.sunset.state.tx.us/ Here is a list up for Sunset review along with SBOT in the 2016-2017 time period. http://www.sunset.state.tx.us/2017.htm For an example or a flavor, Sunset review here is the 2002 report. http://www.sunset.state.tx.us/78 threports/bar/dec_02.pdf
Michele K. replied:
FYI.Being President during Sunset means to be President during the Sunset process which begins way before 2017. So, when people state that the attorney who wins this runoff will be President during the Sunset, they are correct. The following is the anticipated timeline for SBOT sunset review. September 2015 -- Agencies submit Self-Evaluation Reports October 2015 to January 2017 Sunset staff conducts evaluations and prepares reports. Sunset Commission holds public hearings and makes decisions. (in 2015, Sunset Commission staff will set a schedule for the review of each agency in the cycle, each agency typically takes from 3-8 months to review—here is an example of the schedule for the current cycle http://www.sunset.state.tx.us/reviewsch2012.pdf ) February 2017 --- Sunset Commission submits its Report to 85 th Legislature with recommendations on each of the agencies under review.
Toni K. replied:
Susan Durham wow how does that happen.
Joe S. replied:
David Stagner - While we might be able to vote on the position, I think that even if we voted to close up shop, we wouldn't have the power to act on that vote. While the SBOT isn't perfect, I can't see how letting any random legislator, with a desire to make a wild-eyed constituent happy, have unfettered control over us, would be better. ;^)
Our insurance committee has sent you an insurance survey. IF 10,000 attorneys indicate they want affordable health insurance then it should be a reality by 1/1/2014 ....
Joe S. replied:
Ron Chapman - Also, before you get a 12 year old to teach you how to block me, I would point out that I made a comment that would improve the group. People DO need to read the comments before posting the same question over and over. You were the one making the negative and insulting (and obscene) comment. And, you weren't even man enough to admit that you had not read the previous comments.
Terry T. replied:
Agreed Evy! It was insulting to receive those comments in my inbox! Gentlemen - please be so and delete your comments above. We don't need to be brought into your dispute or see your anger. Thanks!
Joe S. replied:
Evy Davis - Sometimes FB gets a little behind. They will send the notifications, but the actual comments are not yet available. I notice this problem more when using FB on my iPhone. As to the flame war, I would protest that I was only trying to cut down on the extra posts caused by people not bothering to read the previous comments. Obviously, in this particular case, that strategy did not work out. I would also point out that, however tempting, I did not resort to obscenity.
Dorothy S. replied:
Really, seems like the questionnaire should be sent to ALL attorneys - even bigger firms would benefit, and a pool of 10,000 is bound to be better than a pool of even a big firm. Wonder who made that decision? perhaps it can be revisited? Man I spoke with said reminders were going to be sent out.
Joe S. replied:
The link to the survey says: If you have any questions, please call Cory Squires at (800) 204-2222 ext 1724. Please complete this questionnaire by Friday, March 15, 2013 at 5:00 pm. Dorothy DuBose Scherr and Joanne Cassidy

Steve F. replied:
The bar has NET assets of $36,375,000 over liabilities and this increases by about $1.8 million a year and just sits in accounts earning .25% interest. I had a proposal to change the price of the Online Library from $295 a year to $39 because only 2016 of our 90,000 attys subscribed, and our survey showed 5000-15000 would pay the $39 for all the CLE classes ( incl many crim classes) over the past 11 years. The bar said letting every attorney have this would DEVALUE the research and could cost $300,000. They have a condescending attitude but they can be beaten.
