Bottom line is seek advice of counsel. Secondly, if you're feeling particularly sassy, use Jessie's standard "tell 'em to bite me!" What I would do is run a search of my database for the subject individual's name, then list the depositions or trials in which the individual appeared and have it on hand when I speak with counsel; perhaps even have on hand the cover pages of the transcripts. I may have none, in which case the issue is moot. If a transcript has been filed and is in the public domain, counsel can get the transcript from the court, and I have no privacy issue.
