I'd send the agency a demand letter itemizing the amounts you are owed and give them 10 business days to make payment, and make sure to send it certified. Make sure to include your current mailing address, and I'd include the phrase "This is my final attempt to collect these monies I am owed before I take legal action." Next, file a complaint with SAG. Doesn't matter if you are SAG, or if the jobs were - the agency might be. If not, SAG still should have a heads up about the company. Next start collecting proof the agency has been paid - write letters/email to all the casting directors and production companies, explaining in VERY business-like detail when you worked on the production, the amount you are owed, and that you are unfortunately now in the position of having to sue and would like verification that the agency was paid the money owed you. If you word it carefully, you can also relay that if they DON'T give you the proof you need, they may find themselves a party in the lawsuit as well. "I'm sorry to be bothering you with this matter as my understanding is that this is my agency not paying me, and not a case of your company not remitting to the agency. If this is not the case, please be advised I have rescinded my check authorization with XX agency, and will need to be paid my fee directly. Please advise if payment has been made within 10 business days by writing me at (address) so that I can proceed with my claim with only the appropriate party." - or something like that. If you are Ohio resident, filing a small claims case in Ohio would be your next step after the 10 business days you gave the agency have expired. Super easy to do, and you can probably have a friend serve the papers. Chances are they'll pay up before you go to court, or you'll get a judgement that will be incredibly hard to collect against.
