Can any Las Vegas Realtor refer me to any agent or broker in Las Vegas that has actually had a lawsuit filed against them by a seller for using the current MLS...

This is the kind of fuel that Zillow and Trulia will use to compete and beat the MLS just like they did to Realtor.com. We should be concerned with Zillow and Trulia starting a nation wide mls rather then scrambling over a few allegedly non mls listings. Its just a matter of time before there is a ZMS... remember that thing called a CMA its now called a Zestimate. Lets take down Zillow and Trulia as first priority. NON realtor third parties are already listing homes on ZILLOW and selling them. Now lets get our priorities straight.
John G. replied:
Tina Africk not broker, but creating policy designed to force agents to use the MLS instead of alternative disposition platforms is anti trust law at its core.

Why would a seller file against an agent/broker,if they are fully informed and sign the exclusion from MLS...I would think this document will protect the agent/broker from getting sued....I haven't heard of any cases, but certainly have worried that some attorney will come in searching for clients that will say they didn't get the highest and best price because it wasn't put in the MLS...concern should be about RE License as well....failure to properly represent the client

John Gafford not to long ago I was calling fsbos looking for a client that wants to basically buy a unicorn. My conversation with one was "we are listed with xyz realtor, can you call them to set up a showing" " I said "I am sorry I didn't see your house on the MLS and you are advertising as fsbo" I called xyz and it was an in-house listing. The fsbo called me back and asked if I had gotten ahold of his agent and I was like yes, but its not available yet for me to show.... He didn't understand what he had signed. What I think Tina Africk and the division are trying to do is protect us as brokers from our selves. If we take off market listings, they are setting it up so the seller can not say they were not informed that brokers from other offices would not know about the sale.
